By accessing or using Yapture ("the App"), available at yapture.app and yapture.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the App or Website.

These Terms apply to all visitors, users, and others who access or use the App or Website. The App and Website are owned and operated by Capswan Studio LLC ("Company," "we," "us," or "our").

2. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

Restrictions

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or attempt to extract the source code
  • Transmit any viruses, worms, or malicious code
  • Use the App for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations

3. User Accounts

You retain ownership of any content you submit, post, or display through the App ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for operating and improving the App.

Content Standards

You agree not to post User Content that:

  • Is unlawful, harmful, threatening, abusive, or defamatory
  • Violates any intellectual property rights
  • Contains personal information of others without consent
  • Is spam or unsolicited advertising
  • Impersonates any person or entity

5. Privacy

Your use of the App is also governed by our Privacy Policy, available at yapture.com/privacy. Please review our Privacy Policy, which also governs the Website and App and informs users of our data collection practices.

6. Purchases and Payments

In-App Purchases

The App may offer in-app purchases. All purchases are final and non-refundable, except as required by law. Prices are subject to change without notice.

Payment Processing

Payment processing is handled by third-party payment processors. We are not responsible for any errors by payment processors.

7. Intellectual Property

Our Property

The App and its original content, features, and functionality are and will remain the exclusive property of Capswan Studio LLC and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

If you believe your copyright has been infringed, please contact us at support@yapture.com with:

  • Description of the copyrighted work
  • Description of the infringing material
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

9. Disclaimers

"As Is" Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's operation or availability.

No Warranties

We specifically disclaim all implied warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy of information

10. Limitation of Liability

To the maximum extent permitted by law, Capswan Studio LLC shall not be liable for any:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, use, or goodwill
  • Service interruptions

This limitation applies regardless of the legal theory, whether in contract, tort, negligence, strict liability, or otherwise.

11. Indemnification

You agree to defend, indemnify, and hold harmless Capswan Studio LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions. Any legal action must be brought in the courts located in Delaware.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by email. Your continued use after such modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
